Company Agreement
Overview
This Agreement is a contract between Bloo Inc. (“Bloo” or “gobloo.com”) and an entity (the “Company”) using its Site (gobloo.com) and Services (Job and Fullancer identification) to find a fullancer identified by Bloo (the “Fullancer” or “Advertiser” and the “Job”).
As a prospective Company, you must read, agree to and accept all the terms and conditions contained in this Agreement in order to use our Site, gobloo.com, and Services.
YOU UNDERSTAND THAT BY USING THE SITE OR SITE SERVICES AFTER THE EFFECTIVE DATE, YOU AGREE TO BE BOUND BY THE TERMS OF SERVICE. IF YOU DO NOT ACCEPT THE TERMS OF SERVICE IN ITS ENTIRETY, YOU MUST NOT ACCESS OR USE THE SITE OR THE SITE SERVICES AFTER THE EFFECTIVE DATE. IF YOU AGREE TO THE TERMS OF SERVICE ON BEHALF OF AN ENTITY, OR IN CONNECTION WITH PROVIDING OR RECEIVING SERVICES ON BEHALF OF AN ENTITY OR AGENCY, YOU REPRESENT AND WARRANT THAT YOU HAVE THE AUTHORITY TO BIND THAT ENTITY OR AGENCY TO THE TERMS OF SERVICE. IN THAT EVENT, “YOU” AND “YOUR” WILL REFER AND APPLY TO THAT ENTITY OR AGENCY.
1. Responsibility for Performance:
Bloo will identify and vet advertising Fullancers on behalf of Your Company. Your Company will then be responsible for interviewing and assessing the suitability of these candidates. Your Company is responsible for making any hiring decisions and Bloo will accept no responsibility for the performance of hired specialists.
A primary role for Bloo is to provide your Company with world-class digital advertising Fullancers, and make sure they continue their excellence.
2. Fullancer Payments:
Bloo earns fees from our Fullancer for finding them jobs. If you hire a Fullancer from our network, all payments to that Fullancer must be made via Bloo’s billing platform. Your Company will ensure that all payments between your Company and a Fullancer are made via Bloo and that Bloo is made aware of all transactions between your Company and this Fullancer in order for Bloo to accurately calculate and collect its fee. Final payment terms will be agreed directly between your Company and Bloo.
3. Engage with the process:
Our advertising Fullancers are in high-demand. In submitting a job brief and accepting these terms, you commit to engaging with the recruitment process in a professional manner and adhering to the Company Professional Standards. This means providing prompt feedback to Bloo and our Fullancers at every stage of the recruitment process.
4. Other Job Terms:
All further agreements (i.e. on job pricing and deliverables) will be made directly between your Company and your Fullancer.
5. Monthly Recurring Payment terms:
Bloo typically works with the following payment terms. Custom terms may be provided in exceptional circumstances.
Bloo bills the first payment when the Company completes their checkout on the Fullancer’s payment checkout page and subsequent payments made monthly thereafter.
The Company can cancel their monthly billing and services anytime after the first three months of service with their Fullancer by contacting Bloo through our contact page or at [email protected].
6. Bloozero – two-week, zero-risk guarantee:
Notwithstanding the provisions of any of the previous terms, where a Company deems a Fullancer’s performance within the first two weeks of service to be unsatisfactory, Bloo will refund the Company in full. In order to take advantage of this Bloozero guarantee, the Company must inform Bloo within the first 14-days of the job’s service commencement date.
7. Use of Company name and job details:
Bloo may, from time to time, share the names and or job details of some of its Companies for promotional use. You can opt-out of this clause by informing us your wish to do so at any time through our contact page or at [email protected].
8. Dispute resolution:
This Agreement, the other Terms of Service, and any Claim will be governed by and construed in accordance with the laws of Pennsylvania Law.
